Terms of sale
Except for Article 9, which applies only to the Metamorphose Bags, these General Terms and Conditions of Sale (“GTC”) apply, without restriction or reservation, to the sale of any product by JOUBERT SARL, a limited liability company with a capital of 1000 euros, whose registered office is located at 41 rue Traversière, 92100 Boulogne-Billancourt, France, registered in the Nanterre Trade and Companies Register under number 884 123 407 (“JOUBERT SARL”) to consumers and non-professional buyers (“Customer(s)”) on the website joubert-paris.com (“Site”), accessible from mainland France.
These GTC specifically outline the conditions for ordering, payment, delivery, and handling of potential returns for products ordered by Customers.
These GTC apply to the exclusion of all other terms, notably those applicable to other distribution and marketing channels.
These GTC are available at any time on the site and will prevail, if applicable, over any other version or conflicting document.
The Customer declares having read these GTC and all the information listed in Article L. 221-5 of the Consumer Code, and having accepted the said information as well as the GTC at the time of creating an account on joubert-paris.com, before proceeding with the online order validation process.
As these GTC may be subject to subsequent changes, the version applicable to the Customer's purchase is the one in effect on the Site at the time the order is placed.
Unless proven otherwise, the data recorded in the computer system of JOUBERT SARL constitutes proof of all transactions concluded with the Customer.
The Customer acknowledges having the necessary capacity to contract and acquire the products offered on the Site.
1. USE OF THE SITE AND INFORMATION RIGHTS
This site contains electronic information which may consist of software, technical information, product documentation, photos, layouts, and other materials. All information on this site is the exclusive property of JOUBERT SARL, and does not become the property of any user by the mere permission to use the site.
Site users may not modify any information obtained from this site in any way, nor reproduce, publicly display, transmit, distribute, or otherwise use JOUBERT SARL's information for commercial purposes or otherwise. For the purposes of these terms, any use of JOUBERT SARL's information on any other website or networked computing environment (including but not limited to publishing Joubert's information on a local Intranet or Extranet) for any purpose is prohibited without JOUBERT SARL's express written permission. Joubert’s information on this site is protected by copyright, and any unauthorized use may violate copyright, trademark, and other laws. If you fail to comply with these terms, your authorization to use this site will be automatically revoked, and you must immediately destroy all JOUBERT SARL information obtained from the site.
Please understand that the restrictions on the use of JOUBERT SARL’s information are designed to protect proprietary information belonging to JOUBERT SARL that is accessible to users of this site. Limitations do not apply, for example, to discussions about our products or website, such as providing feedback on your experience with our products or services on this site or other websites or forums, or posting photos of goods or items from our site that you like or have purchased (such as on other social media sites).
2. INTELLECTUAL PROPERTY
All intellectual property rights, regardless of their nature, attached to the products sold on the Site and/or the elements appearing on it (including, but not limited to, texts, logos, trademarks, graphics, images, photos, videos, animations, names, and any other elements) are the exclusive property of JOUBERT SARL and are exclusively reserved for it. No one is authorized to reproduce, represent, exploit, adapt, disseminate, or use, by any means whatsoever, in whole or in part, the intellectual property rights on the products sold on the Site and/or elements appearing on it, without prior written consent from JOUBERT SARL.
3. PRODUCT INFORMATION
The products offered for sale by JOUBERT SARL are those listed on the site at the time of the Customer's visit.
Product offers are subject to availability as specified when placing the order, and are valid, unless otherwise indicated, as long as the products appear on the site.
The product information on this site is provided for the convenience of our customers and site users, and is as accurate as possible. However, we do not guarantee, either expressly or implicitly, the accuracy of this information or the permanent availability of the products presented on the site. Although we strive to provide our customers with genuine online service and in-store support, we regret that, at times, our products may be out of stock or unavailable in a particular size or color. We also invite you to share any errors you find on our site, so we can correct them promptly.
4. PRODUCT PAYMENT
The prices of products are stated in euros, including taxes, and may be changed at any time by JOUBERT SARL. The price applicable to the Customer’s purchase is the one in effect at the time of placing the order. Discounts or promotional offers may be applied occasionally and will be specified on the Site.
Payment for purchases is made by credit card or any other payment method accepted by JOUBERT SARL and specified during the order process. Payment is due in full upon order confirmation, and the order will only be processed after receipt of payment.
5. GIFT CARDS
5.1 Purpose of the Gift Card
The Joubert gift card allows the recipient to receive a personalized bag made from a sports jersey. It is only valid for ordering a specific model of bag as outlined in the offer associated with the gift card.
5.2 How to Use the Gift Card
The gift card comes with a unique code that must be entered by the recipient on the Joubert website to place an order for a personalized bag.
The order can only be validated after the unique code is entered. No order can be placed without prior use of this code.
The selected bag model corresponds to the one specified in the gift card offer. The recipient cannot choose a different model or request modifications other than those provided in the offer.
5.3 Conditions for Using the Gift Card
One-time Use: The gift card can only be used once for an order and cannot be exchanged for money or combined with other promotions or discounts.
Usage Limit: The gift card is only valid for a personalized bag, as specified in the corresponding offer. Any attempt to use it for another product or offer will be refused.
5.4 Cancellation, Refund, and Invalidity of the Gift Card
The gift card is refundable only if the order has not been validated and before the jersey has been sent. Any refund request must be made in writing and will be reviewed on a case-by-case basis.
Once the order is validated, the gift card becomes non-refundable. No modifications or cancellations of the order can be made after validation.
5.5 Validity of the Gift Card
The code associated with the gift card has a limited validity period of 12 months, as specified on the card. After this period, the gift card can no longer be used and will automatically become invalid.
6. SHIPPING, EXPENSES, AND DELIVERY
The Customer will be notified on the homepage in case of a non-shipping period (e.g., during vacations).
Shipments are made worldwide.
Shipping fees appear on the summary screen before order validation. Shipping fees vary based on the weight of the package and the destination.
If the ordered products are available, the order will be shipped within one to three working days from the day after the order is validated by JOUBERT SARL.
After the products are shipped by JOUBERT SARL, the delivery time will be about 2 working days for any shipment by Colissimo recommended in France. The customer will have the ability to track their package using the tracking number provided by email when the order is sent. The package is delivered against a signature.
